2. Wirtz International does not have a data protection officer (‘DPO’) and has no obligation to appoint one. Wirtz International complies with all the rules of the European Regulation 2016/679 of 27 April 2016 on the protection of personal data (hereafter: “GDPR”), the Belgian legislation on the protection of privacy and the European Directive 2002/58/EC of 12 July 2002 on the processing of personal data and the protection of privacy in the electronic communications sector (hereinafter referred to as: “ePrivacy Directive”), jointly: “Privacy law”.
2. PROCESSING ACTIVITIES
Within the framework of its activities, Wirtz International carries out the following processing activities:
1. Customers:
What data? The name, names or commercial names of our customers, if applicable, legal form or gender and if applicable that of their representatives, the addresses, registered office or domicile, telephone, GSM and/or fax number, e-mail address, VAT number and other billing data, our contract, our correspondence, the plans, designs and other creations, our own reference number at Wirtz, etc.
Purpose? We process this data to identify and individualise you, for administrative purposes, for smooth communication, monitoring and execution of the agreement, subsequent feedback and accounting.
Legal basis? Processing is also necessary to provide you with the services requested by you and to be able to perform the contract at your request (art. 6 1 b GDPR). The processing is also partly based on the legal obligation to keep accounts (art. 6 1 c GDPR).
Storage period? We store this data from the moment you contact us until the order has been completed. After that, we retain all data for ten years, in accordance with architects’ legal responsibility for structural defects.
2. References:
What data? The customers’ names, the description of the project and images, photos, designs and plans of the project.
Purposes? To provide recent example projects on the Website for reference.
Legal basis? The processing is based on consent (art. 6 1 a GDPR).
Storage period? We retain this data for twenty years, unless the consent given was previously withdrawn.
3. Suppliers:
What data? The name, names or commercial names of our suppliers and, where applicable, of their representatives, the addresses, registered offices or residence, telephone, mobile phone and/or fax number, e-mail address, VAT number and other billing data, if applicable, our contract, our correspondence, a description of the goods or services supplied, etc.
Purpose? We process this data to identify and individualise you, for administrative purposes, for smooth communication, monitoring and execution of the agreement, subsequent feedback and accounting.
Legal basis? The processing is also necessary for placing orders and delivering the goods or services (art. 6 1 b GDPR). The processing is also partly based on the legal obligation to keep accounts (art. 6 1 c GDPR).
Storage period? We retain this information for ten years to meet our accounting obligations.
4. Contacts:
What data? Names, contact details, images and other information you provide to us.
Purpose? We maintain contact with professionals and other interested parties who we meet at lectures, guest lectures, fairs and events and who give us their contact details.
Legal basis? Provision of the information can be considered unambiguous consent to processing (art. 6 1 a GDPR). In addition, it is in any event in the legitimate interests of Wirtz International to maintain a solid network for its activities (art. 6 1 f GDPR).
Storage period? We keep the data until the party concerned withdraws its consent.
5. Applications:
What data? Names, physical and e-mail address, telephone and mobile phone numbers, curriculum vitae with all the information the applicant includes therein, cover letter, any notes on interviews or assessments, correspondence and all other information the applicant has provided to Wirtz International within the context of an application.
Purpose? We process this information at your request and initiative to consider your application within the context of potential recruitment or association.
Legal basis? The processing is necessary to perform the actions required to conclude a contract (art. 6 1 b GDPR).
Storage period? We will retain this data for the duration of the application process. If an applicant is not hired, we will delete all data after 5 years.
6. Contact:
What data? Name, e-mail address, message content and subsequent correspondence.
Purpose? Interested parties can send us an e-mail or use our contact form at any time. The data is processed to facilitate an efficient response to incoming messages.
Legal basis? Processing is necessary to be able to provide you with the service you have requested (to respond to your message) (art. 6 1 b GDPR) to process this data.
Storage period? After answering your questions or responding to your comments or messages, we delete all data after 5 years.
7. Cookies:
Some of the cookies used are also used to process some of your personal data. For an overview, please refer to Article 6 of this Privacy & Cookie Policy.
What data? IP address, your consent to cookies, your status, some analytical cookies, information about your browser and terminal equipment, the frequency of your visits to the website, the date of your first and most recent visit, the time of your visit and departure from the website, where you came from, which search engine you used, your search term and the link you clicked on to reach us, as well as personal data.
Purpose? The data is processed to retain your consent and to gain a better insight into how the Website is used.
Legal basis? We ask for your explicit consent (art. 6 1 a GDPR). For cookies where an opt-in is not required, we invoke a legitimate interest to gain insight into the operation and the use of the Website (art. 6 1 f GDPR).

3. TRANSFER
1. We protect your personal data well from the outside world. For certain purposes, we do pass on your personal data to third parties that provide us with services, such as an accountant for accounting purposes, a lawyer for legal procedures, a web developer for the maintenance of our website, IT providers for the use of certain cookies, etc.
2. No data will be passed on to third parties, except for technical processing purposes. Your data will certainly not be sold or transferred for any commercial use whatsoever.
3. However, a transfer is possible in the event of the reorganisation or bankruptcy of Wirtz International, or the transfer of all or part of the activities of Wirtz International. In such a case we will do everything in our power to inform you as soon as possible.
4. In rare cases, we may be required to disclose or pass on your information pursuant to a court order or to comply with other mandatory laws or regulations. We will make every effort to inform you of this in a timely manner, unless it is subject to legal restrictions.
5. The data we collect and process using Google Analytics cookies will be transferred to the United States. Google Inc. is subject to the US-EU Privacy Shield protocol and transmission should therefore be secure. Furthermore, your data never leaves the territory of the European Union.
